The dissertation is devoted to the administrative and legal regulation of ensuring the availability of legal aid for persons with disabilities. It was determined that legal assistance is a general concept that covers all types of assistance aimed at ensuring the realization of human and citizen rights and freedoms, their protection and restoration in case of violation. This may include consultations, clarification of legal issues, assistance in drafting statements, complaints, procedural documents, as well as representation of interests in courts and other state bodies. Professional legal assistance – assistance provided by qualified lawyers who have the appropriate training and authority to ensure the protection of the rights and interests of citizens in court and other legal processes. This includes consultations, representation in courts, preparation of procedural documents and other types of legal services provided by professional lawyers in accordance with the law. Legal assistance is legal assistance specified in legal content, which has a regulatory nature and is provided on the basis of current legislation. Legal assistance involves the provision of legal services within the framework of contractual relations between the client and a lawyer (advocate), including consultations, preparation of legal documents, representation in court and other institutions.
It is noted that the institute of accessibility of legal aid for persons with disabilities is designed to ensure the effective protection of their rights and interests in the legal system, where the availability of legal services is equivalent to their quality, because for people with disabilities the category of accessibility is decisive, which includes not only the physical ability to visit legal services institutions, but also the adaptation of information resources, the availability of communication tools and the financial availability of legal services, which the legal system must take into account in order to guarantee effective support and protection of the rights of this category of citizens. Affordable legal aid is characterized by the fact that it ensures equal access to justice for all citizens, regardless of their financial situation. It is an important tool for guaranteeing the realization of the rights and freedoms enshrined in the Constitution of Ukraine, and contributes to the strengthening of the rule of law. Its features are free of charge, universality and professionalism. The main barriers to accessibility to facilities and services for persons with disabilities that limit their ability to use these services are mental, physical, informational, institutional, financial, technological, psychological, cultural, communication and social barriers.
It was found that the principles of ensuring the availability of legal aid for persons with disabilities are a set of fundamental principles aimed at creating conditions of equal access to legal services for all citizens, ensuring nondiscriminatory treatment and the realization of their rights through the integration of special support mechanisms that take into account unique needs and limitations of these persons in the legal system.
The author claims that the state policy of ensuring the availability of legal aid for persons with disabilities is a set of measures developed and implemented by public authorities in order to eliminate barriers that prevent persons with disabilities from fully enjoying their rights to legal aid.
It has been proven that the state policy of legal aid availability for persons with disabilities is an integral component of the general policy of social protection in Ukraine, which requires a comprehensive approach and adaptation to modern challenges, including the increase in the number of persons with disabilities due to military operations. In the author's work, the need for the implemented state policy strategy "Legal support without obstacles" is proven. The implementation of this strategy aims to ensure effective and equal access to legal aid for all citizens, promoting the full integration of persons with disabilities into society and ensuring the realization of their rights and freedoms.
