Essay

The dissertation is devoted to the development of theoretical and methodological principles of administrative and legal support of postgraduate education of police officers and the formulation of practical recommendations for improving profile legislation. The author's definition of postgraduate education of police officers as an object of administrative and legal regulation is provided. Its key features are highlighted: the processes of its implementation are regulated by administrative and legal norms, which together form special legislation; it has a specific subject composition, clearly defined by legislative provisions; is based on the already acquired educational level and practical experience of the police officer; has a dualistic nature, which manifests itself in the combination of personal (subjective), as well as state and public (objective) interests. It has been determined that postgraduate education of police officers as a legal institution is considered as: 1) a legal tool for personnel management in the system of the National Police of Ukraine; 2) a proactive state service provided to a police officer to maintain his proper qualification level; 3) internal monitoring carried out by the management bodies of the Ministry of Internal Affairs of Ukraine of the knowledge and skills of police officers through their digital profiles in order to timely identify gaps in the knowledge of the latter and automatically adjust the individual educational trajectory within the framework of postgraduate training; 4) public-legal relations within the framework of the internal organizational administrative activities of the Ministry of Internal Affairs of Ukraine and the National Police of Ukraine; 5) as a mandatory component of service in the National Police of Ukraine, etc. The author's vision of the tasks of postgraduate education of police officers is proposed, which are considered as a set of specific areas of activity of subjects authorized by the state, regulated by regulatory and legal regulations, the implementation of which is aimed at acquiring, updating and improving professional knowledge, skills and competencies of police officers; it is substantiated that the implementation of these tasks is carried out in order to achieve the specified goal of their official activity and ensure the effective and operational functioning of bodies and units of the National Police of Ukraine in modern conditions. A scientific classification of the principles of postgraduate education of police officers is carried out depending on the scope of their distribution: 1) general principles: rule of law, legality, observance of human rights and freedoms, equality and non-discrimination; 2) principles of police activity: openness and transparency, interaction with the population on the basis of partnership, professional and ethical restrictions; 3) principles for ensuring the realization of the right to postgraduate education: political neutrality, accessibility of education, continuity of education, ensuring the quality of education, state support, academic integrity, mobility and freedom. It has been established that the legal framework for postgraduate education of police officers constitutes a complex, multi-level system of regulatory legal acts, which is systematized in the work according to three key criteria. First, a hierarchical vertical is distinguished by legal force, which includes the Constitution of Ukraine, international treaties, laws of Ukraine and a set of subordinate legislation. Second, the acts are classified by the subjects of their adoption, among which the decisive role belongs to the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine, as well as the Ministry of Internal Affairs and the Ministry of Education and Science of Ukraine as bodies that ensure sectoral regulation of postgraduate education of police officers. Third, the acts are differentiated by the subject of regulation into those that determine the general principles of the functioning of the system and those that regulate special aspects: the legal status of subjects, mechanisms for ensuring the educational process, priority areas for improving police activities and strategic vectors for the development of postgraduate education of police officers. It is proved that such a three-level classification of the legal foundations of postgraduate education of police officers allows to ensure the integrity of the administrative and legal impact on the studied sphere of public relations and to optimize the professional training of personnel in accordance with the modern needs of society and the state.
