The paper presents a theoretical generalization and a new solution to the scientific problem, which lies in identifying the essence and revealing the peculiarities of the administrative and legal basis for defining risks and threats in the economic sphere through the implementation of the analytical function of the Economic Security Bureau of Ukraine (ESBU), on the basis of which to develop proposals and recommendations aimed at improving the legal and organizational foundations for the implementation of the analytical function of the ESBU.
Economic security of Ukraine is proposed to be understood as a normal, state-guaranteed state of functioning of the national economy, characterized by compliance with the requirements of legislation and international standards by all participants in socio-economic relations, the effective and socially oriented operation of all economic markets, the stability and sustainability of the national currency, and the correct and fair distribution of material and financial resources in society, which together contribute to sustainable state and economic development, prosperity, and an improved quality of life for the population.
It has been established that the entities responsible for ensuring the economic security of the State are a system of state institutions which, in accordance with the provisions of the current legislation of Ukraine, are empowered to manage and regulate socio-economic relations and the behavior of their participants using administrative and other instruments in order to maintain the proper functioning of the national economy in general and its individual components in particular.
It has been noted that the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the President of Ukraine, and the National Security and Defense Council of Ukraine subordinate to him establish the foundations for ensuring the economic security of the State by: 1) forming the regulatory and legal basis for the functioning of the national economy; 2) determining the directions and organization of the State economic policy; 3) establishing and ensuring the functioning of a mechanism for State regulation and management of the economic, credit and financial, manufacturing, and other sectors of the national economy; 4) forming a strategy to counter threats and risks in the economic sphere.
It has been justified that the analytical function of the Economic Security Bureau of Ukraine is an independent area of the ESBU activity, which is implemented by specially authorized analytical units of this law enforcement agency with the aim of collecting and processing information about threats and risks in the economic sphere, the causes, conditions, and facts of administrative and criminal offenses, the counteraction of which falls within the competence of the Bureau.
It has been stated that the administrative and legal relations regarding the implementation of the analytical function of the Economic Security Bureau of Ukraine should be defined as social relations regulated by administrative legislation arising within the framework of the administrative activities of the authorized units of the Bureau in terms of the organization and implementation of the analytical function and the objectives set for the agency. These relationships are characterized by a clear legislative definition of the rights and obligations of their participants, as well as the possibility of applying coercive measures to them to regulate and ensure the correctness, efficiency, and legality of their activities.
It has been emphasized that the staffing of the analytical activities of the Economic Security Bureau of Ukraine is a special activity of the authorized persons of the Bureau, which is aimed at forming the personnel of the analytical units of the ESBU, as well as ensuring their service. In this case, numerous administrative relations arise related to the organization of competitive selection for positions in the analytical units of the ESBU, the appointment and dismissal of their managers, control of the process of official activities and ensuring the official and labor rights of personnel, conducting their professional training, etc.
