Rudenko O. Risk Management in the Field of Border Control as a Means of Preventing Illegal Crossing of the State Border

The dissertation provides a theoretical generalization and proposes a new solution to a scientific problem, which consisted in clarifying the essence, content, and specific features of risk management in the field of border control as a means of preventing illegal crossing of the state border. On this basis, proposals and recommendations aimed at improving administrative legislation regulating the relevant social relations have been developed. Based on the results of the study, a number of scientific and practical conclusions and recommendations have been formulated. The prevention of illegal border crossing is characterized as an object of administrative and legal research and as a subject of activity of the State Border Guard Service of Ukraine. The concept is defined and the essence of risk management within the system of integrated border management as a component of the administrative activity of the State Border Guard Service of Ukraine is revealed. A classification of risks in the field of border control carried out by the State Border Guard Service of Ukraine is provided. International standards of risk management at the border are generalized and possibilities for their implementation in the activities of the State Border Guard Service of Ukraine are examined. The legal status of the State Border Guard Service of Ukraine, which carries out risk management when crossing the state border, is disclosed. Forms and methods of identification and assessment of risks of illegal border crossing by the State Border Guard Service of Ukraine are distinguished. The interaction of the State Border Guard Service of Ukraine with other state authorities in the process of minimizing border risks is characterized. Ways of optimizing the legal regulation of border control procedures on the basis of a risk-oriented approach are elaborated. Directions for improving the procedure of administrative liability for violation of the rules of crossing the state border are clarified. Ways of harmonizing Ukrainian legislation in the field of border security with the law of the European Union in view of the prospect of accession to the Schengen Area are determined.
