Essay

The dissertation solves the scientific problem of theoretical and pragmatic research of legal regulation of the institution of representative democracy at the current stage of constitutional reform in Ukraine with a view to identifying shortcomings and developing proposals for their elimination. The author argues that the institution of representative democracy in Ukraine is a system of substantive and procedural rules which regulate the constitutional and legal framework for the functioning of the Parliament, the Head of State and representative local self-government bodies. This institution has a cross-sectoral nature, performs constituent and regulatory functions and covers three sub-institutions: the Parliament, the Head of State and representative local self-government bodies. It is determined that the institution of representative democracy in Ukraine is characterised by a number of features of both general and special nature. The general features include: a) the use of doctrinal and constitutional instruments; b) the presence of its own subject matter of legal regulation within the framework of constitutional law; c) functional orientation; d) normative differentiation of groups of norms in the sources of constitutional law. The general features should include: a) the profiling nature of the institution; b) the connection with other branches of law; c) the synergy of stability and dynamics of the institution's provisions which ensures its development and adaptation to new challenges. The author proposes to systematise doctrinal studies of the institution of representative democracy in Ukraine in the following areas: a) general theoretical studies covering the evolution, constitutional and legal framework and theoretical aspects of representative democracy; b) special studies relating to specific representative bodies (the Verkhovna Rada of Ukraine, the President of Ukraine, local councils, and village, town and city mayors). This approach streamlines the scientific base, helping to highlight the key aspects of legal regulation of the institution of representative democracy. Based on the analysis of the provisions of the 1996 Constitution of Ukraine regulating the institution of representative democracy: a) it is proposed to amend the Constitution of Ukraine by supplementing Article 86 with parts three and four as follows: "A Member of Parliament of Ukraine may submit an interpellation to the Cabinet of Ministers of Ukraine, a member of the Cabinet of Ministers of Ukraine or the head of another central executive body on issues within their competence. A Member of Parliament of Ukraine has the right to receive a response within 30 days. The response to the interpellation is subject to discussion in the Verkhovna Rada of Ukraine, which may be associated with a vote of no confidence‘; b) using the statistical, analytical and historical methods, the author proposes to amend Section V ’President of Ukraine" of the 1996 Constitution of Ukraine by restating it in a new wording; c) further argues that it is inexpedient to duplicate the provisions of the 1996 Constitution of Ukraine in the laws of Ukraine, as this may lead to legal confusion, reduce the authority of the Fundamental Law and аvoiding duplication will help to maintain clarity, stability and efficiency of the legal system.
