Essay

The dissertation study notes that the state is a key actor in the implementation of social protection, although this role is not always consistent with the current regulatory framework. The regulation of social protection mechanisms is carried out at the central level by adopting relevant regulatory legal acts, however, the financing of its individual elements, for example, in the field of health care, is often entrusted to the budgets of local governments. Such a model corresponds to the strategy of European integration of Ukraine, one of the fundamental principles of which is the implementation of the principle of decentralization and strengthening the autonomy of local government structures in the field of social policy. It is noted that social protection acts not only as a public law construct, but also as a fundamental right guaranteed by international law of every person – regardless of their civil status. It is emphasized that social protection should include both preventive actions aimed at preventing social risks and compensatory mechanisms that are activated in the event of their occurrence. The recognition of social risk as an event that potentially threatens the economic, social or natural rights of an individual forms a conceptual basis for the legitimate application of social security measures. As for civil servants, the social protection system in their case is characterized by a higher level of legal guarantees, compared to other categories of employees. This is explained by the fact that the state is the only entity capable of providing them with an adequate level of material support in the event of the occurrence of relevant risks. In addition, in accordance with modern European trends, the social protection model should also be expanded to include the prevention and overcoming of the negative consequences of not only physical, but also psycho-emotional risk factors that affect the quality of life and professional stability of civil servants. It is substantiated that social protection can be characterized as a holistic, coordinated activity of public authorities aimed at providing legal, economic and organizational support to subjects of law in conditions of occurrence or threat of occurrence of social risk. The specified activity provides for both preventive measures aimed at reducing the probability of risk and compensatory mechanisms to minimize its negative consequences, in order to ensure the effective implementation of guaranteed social rights, the creation of safe, stable and decent living conditions, in particular in the professional environment.
