Essay

The dissertation is a modern comprehensive study and continuation of the scientific development of the problems of implementing international legal standards in the field of law enforcement activities into the national legal systems of states. Scientific novelty is due to the formation, proof and obtaining of new knowledge on the topic of the work, the subject of which is a relevant and important area of scientific knowledge. The dissertation has formed and substantiated a number of new conceptual provisions and conclusions that have scientific novelty. It is argued that the theoretical study of the influence of international legal standards in the field of law enforcement and their implementation in the national legal order in historical, legal and logistical aspects puts the institutional aspect in the first place. It is motivated that it is necessary to simultaneously study the international unification aspect, as well as the aspect of constitutionalization, that is, when national legislation on the activities of law enforcement agencies of a separate or separate states influenced the emergence of new international standards in international legal acts. A personal vision of the category "implementation" as the main category has been formulated. This is the process of developing and adopting national legislative and other regulatory legal acts on the functioning of judicial and law enforcement bodies based on the mandatory implementation of international norms and principles contained in international treaties to which the state is a signatory and participant, and whose binding consent has been given by national parliaments. Other categories have been developed that are derivatives of the implementation category. Implementation practice is the purposeful activity of lawmakers of a nation state to develop and adopt national legislative and other regulatory legal acts on the functioning of judicial and law enforcement bodies by implementing the binding provisions of international treaties to which the state is a signatory and party and whose binding consent has been given by national parliaments. It is stated that taking into account the phenomenological nature of international legal standards, their contradictory and changing legal nature, significant objects of international legal significance regulated by them, as well as a wide range of subjects related to their application, a wide range of methods, techniques and principles of knowledge of legal reality are used in the research and study of the above phenomena of modern international public law and national constitutional law of states. The author's definition of international legal standards in the field of national law enforcement systems is proposed - these are, firstly, the rules for organizing law enforcement activities themselves, provided for in international law, and, secondly, the rules for organizing and operating each state body that belongs to the judicial or law enforcement. The article investigates the proposition that the comparison of international standards in the profile area with national legislative acts allows answering a number of questions of methodological and praxeological nature: to what extent international legal sources, where standards for the organization and implementation of law enforcement activities are defined, have influenced Ukrainian legislation in determining the basic principles of the organization and implementation of law enforcement activities; whether the national legislator has fully taken into account the obligations and recommendations of the sources of international law; whether the legal provisions of national legislation correspond in content to the content of international standards. The proposition about the need to pay attention to the substantive content of the principles themselves, contained in international legal acts and defined as international legal standards in the profile area, is substantiated: a) all principles have a vague content that cannot be grasped by reason or consciousness from the standpoint of how these principles can be adhered to in the process of activity; b) the specified principles can most likely be used as evaluation criteria after the completion of the activity.
