Essay

The Thesis provides a theoretical generalization and proposes a new solution to a scientific problem, which lies in revealing the theoretical and praxeological aspects of the functioning of the administrative and legal mechanism for the development of territorial communities in the context of informatization and, on this basis, formulating a corresponding scientific concept. As a result of the research, the conceptual foundations for achieving the set goal have been formulated. It has been noted that over the past decade, the issues of territorial communities’ development, their legal status, and the specifics of their functioning have occupied a prominent place in the research of scholars in the field of administrative and legal science. At the same time, despite the existence of a significant body of theoretical work, this topic remains controversial and gives rise to new directions in scientific research. In particular, contemporary doctrine lacks a comprehensive analysis of the administrative and legal mechanism for the development of territorial communities in the context of digitalization. It has been argued that a territorial community is a complex category with a wide range of characteristics; therefore, it should be interpreted in both broad and narrow senses. Thus, in the narrow sense, it refers to individuals permanently residing within the boundaries of an administrative-territorial unit established by law, who constitute the primary element of the local self-government system. According to the broad approach, a territorial community is the collective of residents of a separate administrative-territorial unit, united by the fact of living together, social relations, endowed with local self-government, as well as the rights to independently resolve issues concerning their daily lives, determine the direction of the territory’s development, own, manage, use property, and pursue financial, economic, and other common interests. Emphasis has been placed on the unique legal status of territorial communities, which has no analogues in either form or substance. The need to improve the Law of Ukraine «On Local Self-Government in Ukraine» has been noted; this Law should be supplemented with a more precise definition of a territorial community and include the proposed list of tasks and principles in its articles. It has been stated that this, as it appears, will contribute to the development of the legal framework governing territorial communities, as well as the organizational foundations of their functioning. It has been emphasized that the digital transformation of territorial communities is a comprehensive and consistent process of actively introducing digital technologies and the latest digital solutions into the daily activities of territorial communities and local self-government bodies, with the aim of optimizing communication processes among community members, improving the efficiency of public service delivery, and enhancing other operations and activities. It has been argued that the modernization of public administration is a comprehensive process of updating the system of organizing, functioning, and the methods of operation of State authorities and local self-government bodies with the aim of increasing their efficiency, transparency, and ability to respond to contemporary societal challenges and threats.
