Savkin O. Philosophical and methodological foundations of establishing the truth in the process of criminal proceedings

The paper examines the philosophical and legal foundations of the methodology for solving a number of contradictions caused by removing the establishment of truth from the list of tasks of criminal proceedings with the transition to its adversarial model. Therefore, the formulation of such principle foundations is the main goal of the dissertation. Given the multidimensionality of the problem of truth in modern science, the analysis of ways to resolve the mentioned contradictions was carried out in three main aspects, such as philosophical-epistemological, methodological and normative. Moreover, the relevance of research in these directions is enhanced by large-scale discussions going on in their context in modern scientific literature. The methodological basis of the dissertation work was served by classical and modern concepts of truth in philosophical and legal science, as well as specifications of their practical application in the field of criminal proceedings. In the course of the research, a complex of philosophical, general scientific and special methods was used. The dissertation is the first monographic study in which a systematic philosophical and legal justification of the need to preserve the normative requirement of establishing the truth during criminal proceedings in the conditions of the current reformation of the criminal process is carried out. In particular, it has been proven that due to the epistemological diversity of philosophical and criminal-procedural knowledge, any contradictions in the philosophical concepts of the nature of truth cannot serve as grounds for rejecting the concept of "truth" in criminal proceedings.
