Parkhomenko L. Transformation of state regulation of procurement of engineering and consulting services in construction

The dissertation provides a comprehensive theoretical generalization and proposes a new solution to the scientific problem related to the substantiation of the conceptual, regulatory, and organizational and managerial principles of the transformation of mechanisms for state regulation of procurement of engineering and consulting services in construction. The work is aimed at the formation of scientific and practical recommendations for improving the current public procurement system, taking into account international experience, modern management approaches, and innovative tools. The genesis of the public procurement system in Ukraine is studied from a historical perspective, the stages of the formation of regulatory regulation in the field of procurement of engineering and consulting services are analyzed, and key institutional and economic prerequisites for development are identified. Based on the analysis of scientific sources and current legislative acts, theoretical approaches to state regulation of these services are substantiated, the features of their legal status, the specifics of the formation of technical tasks, and the criteria for evaluating proposals are determined. An in-depth analysis of the current state of the organization of procurement of engineering and consulting services in construction in Ukraine was conducted. Systemic problems were identified: insufficient detailing of requirements for the qualification of participants, low level of competition in tenders, limited practice of applying non-financial evaluation criteria, as well as risks associated with a formal approach to control. Special attention was paid to the analysis of the activities of the Antimonopoly Committee of Ukraine as an appeal body in the field of public procurement, its role in ensuring fair competition and eliminating barriers to market access was determined. The paper examined international experience in regulating procurement of engineering and consulting services, in particular, models used in the EU, the USA and Canada. Promising tools that can be adapted in Ukraine were identified: a system of pre-qualification of suppliers, multi-criteria evaluation of proposals, the use of open contracts, the creation of centralized procurement bodies. Based on the generalization of international practice and the results of domestic analysis, conceptual principles for the transformation of procurement procedures for engineering and consulting services are proposed. Key areas of modernization are identified: digitalization of procurement processes using artificial intelligence and Big Data technologies, improvement of electronic monitoring systems, introduction of flexible contract models focused on the final result. Scientifically based recommendations are proposed for the implementation of new management solutions, which include: increasing transparency and accountability of procurement procedures; expanding public control mechanisms; building the human resources potential of procurement bodies; increasing the level of specialized training of specialists in the field of engineering and consulting. Particular attention is paid to the issues of harmonization of national legislation with EU law and international procurement standards. The implementation of the approaches proposed in the dissertation will allow to increase the efficiency and effectiveness of state regulation in the field of procurement of engineering and consulting services in construction, will contribute to reducing corruption risks, ensuring competitiveness, optimizing budget expenditures and improving the quality of construction projects.
