The dissertation is the first comprehensive study in Ukrainian administrative and
legal science dedicated to administrative and legal regulation in the field of DanceSport
in Ukraine. The work examines the modern model of public administration in the field of
DanceSport, which combines the institutional heritage of the Soviet administrativecommand system and the imperatives of the global transnational legal order (lex
sportiva). Based on this research, conducted through the prism of an in-depth analysis of
the legal collision in DanceSport, a holistic, scientifically grounded concept for the
systemic improvement of public administration in the field of sport has been developed
in accordance with modern European legal standards of good governance.
The relevance of the work is conditioned by the fact that in the 21st century, sport
has transformed into a complex globalized phenomenon functioning under the conditions
of a fundamental legal dichotomy between the autonomous transnational legal order (lex
sportiva) and national legal systems striving to preserve administrative influence on the
field. For Ukraine, this collision is complicated by the deep-rooted heritage of the Soviet
administrative-command system, which, despite the declarative recognition of the
autonomy of public organizations, preserves the phenomenon of "hollow autonomy" of
sports federations through mechanisms of hidden financial and administrative control.
The strategic course toward European integration requires the abandonment of archaic
practices and the creation of a new legislative foundation; however, the current regulation
model, based on framework legislation and excessive discretion of executive bodies,
leads to systemic challenges for the administrative and legal regulation of the field. A
vivid indicator of these flaws is the sphere of DanceSport, where, as a result of the
fragmentation of the legal field and reactive administration, a unique legal collision has
emerged regarding the parallel existence of two identical sports – "DanceSport"
(tantsiuvalnyi sport) and "Sports Dance" (sportyvni tantsi). This makes the field an ideal
object for analyzing systemic problems and developing a concept for the fundamental
improvement of public administration in the field of sport in accordance with European
standards of good governance.
The issue of administrative and legal regulation in the field of DanceSport has not
been previously researched in domestic legal science and has been very fragmentarily
explored in foreign publications. Previous studies by legal scholars concerned other
aspects of legal regulation in the field of physical culture and sport, particularly the system
of subjects of administrative and legal regulation of the field of physical culture and sport,
the administrative and legal principles of sports federations’ activities and the
peculiarities of their legal status, the subject of sports law and its place in the legal system,
the content of the constitutional-legal guarantee of the right to sport, public administration
in the field of sport, and civil-law aspects of the autonomy of sports organizations. Sport
as a unique social phenomenon is also widely studied in other sciences, particularly in
philosophy, sociology, psychology, economics, history, and management.
