Essay

The dissertation is devoted to a comprehensive theoretical and historical study of the emergence of the state as one of the fundamental problems of the contemporary theory of state and law. The work substantiates that the issue of state genesis cannot be reduced merely to the reconstruction of remote historical facts or to a formal presentation of the classical theories of the origin of the state, since the question of how and under what conditions the state emerges is directly connected with an understanding of its essence, social purpose, functions, limits of legitimacy, and relationship with law. The emergence of the state is considered as a complex cognitive model within which historical material acquires significance not in itself, but as a basis for forming general theoretical conclusions regarding the nature of public authority, its institutionalization, territorial organization, normative formalization, and legitimation. The relevance of the topic is determined by the need to overcome simplified and dogmatized approaches to explaining state formation, as well as by the special importance of the problem of statehood for Ukraine in the context of contemporary threats to sovereignty, the need to preserve historical and legal continuity, strengthen national identity, and ensure the institutional resilience of the state. In this context, the study of the origins of the state has not only theoretical but also worldview-related, legal, and practical significance, since it makes it possible to comprehend the state as a historically formed mode of the political and legal self-organization of society.
