Marchuk R. Administrative and legal bases for the organization and activities of the State Bureau of Investigation of Ukraine

The reasons and the prerequisites for the creation of SBI have been outlined. The historical background and the establishment of SBI as the specific element of national law enforcement system have been studied. The concept of SBI has been formulated and its features as a law enforcement agency have been revealed. The classification of State law enforcement agencies of Ukraine according to different criteria has been made, the place of SBI in each of them has been determined. The author’s view on the national law enforcement system has been given. The peculiarities of administrative and legal status of SBI as the central government body have been revealed. The main directions of the approved legislation of the consolidated model of administrative and legal status of SBI have been identified. It has been concluded that it is advisable to remove SBI from the system of executive bodies and to grant it the status of an independent law enforcement agency. The concept of “SBI system” has been given, its features have been revealed and the main ways to optimize it have been proposed. The author’s definition of the concept of “organizational structure of SBI” has been formulated, its main features have been defined and the ways of its improving have been determined. The peculiarities of the legal regulation of the organization of activities of SBI officials have been analyzed and the proposals for their improvement have been substantiated.
