Essay

The thesis is the first scientific research in the Ukrainian legal science, which characterizes the nature and the features of the administratively-legal regulation of an international passengers` sea shipping as a direction of public administration to implement the international obligations in the sphere of merchant shipping and the state maritime policy of Ukraine. The need to consider an international passengers` sea shipping as an object of the administratively-legal regulation, determined by the specificity of the rights and the obligations of a port State and a flag State, as determined by the international treaties, as well as the goals and the objectives of implementation of the national maritime policy, has been justified. The public legal elements of the administratively-legal regulation of passengers` sea shipping have been defined. It has been proved that the legal regime, which regulates an international passengers` sea shipping, is implemented by the Ukrainian subjects of power and determines the content and the tasks of public administration of the sphere of passengers` sea shipping. It has been proposed to define the administratively-legal regulation of passengers` sea shipping as a set of administratively-legal norms, aimed at ensuring the rights and the legitimate interests of individuals, legal entities and a state in relations in the sphere of passengers` sea shipping, which together form the administratively-legal regime, which regulates the activities of subjects of passengers` sea shipping. The administratively-legal measures to promote the development of maritime tourism have been defined. The role of the international non-governmental organizations in the formation of soft law norms (the standards, the recommendations, the best practices), which regulates activities in the sphere of maritime tourism has been noted.
