Kolodchyna R. Administrative and Legal Regulation of Providing Psychiatric Help in Ukraine

The dissertation is devoted to the study of the content and features of the administrative and legal regulation of the provision of psychiatric help in Ukraine. The definitions of the concepts of "administrative and legal regulation of psychiatric help", "administrative and legal protection of mental health", "administrative and legal guarantees on the realization of the rights, freedoms and legitimate interests of persons suffering from mental disorders" have been formulated, and their characterization has been carried out. The functions reflecting the peculiarities of the regulatory influence of management agencies in the field of psychiatric help have been characterized. A classification of subjects and forms of administrative and legal regulation of the provision of psychiatric care is proposed. The author has accomplished the classification of methods of administrative and legal regulation in the field of providing psychiatric help into general and special methods. The main administrative and legal means of regulating the provision of psychiatric help have been singled out. The author of the dissertation has accomplished a comprehensive research of theoretical and legal principles, identification of tendencies for providing psychiatric help in Ukraine, identification of problems of its administrative and legal regulation, as well as the development of practical recommendations and suggestions aimed at improving national legislation in this area.
