Bosniuk O. Legal regulation of the use of phytosanitary measures in the agriculture of Ukraine

Dissertation for obtaining the degree of Candidate in Law in specialty 12.00.06 – land law; agrarian law; ecological law; natural resource law. ‒ Lesya Ukrainka Volyn National University; National University «Odesa Law Academy», Odesa, 2024. In the dissertation, a comprehensive scientific analysis of the legal regulation of issuing, circulation and execution of agrarian receipts in Ukraine was carried out, theoretical generalizations and practical proposals were formulated, which in general solve an important scientific task and are aimed at improving the regulatory support of relevant social relations. The peculiarities of the formation and development of domestic legislation on agrarian receipts are determined: a) long-term immutability of the provisions of the special law; b) application of the pilot project; c) the existence of general legislation that regulates relations regarding agrarian receipts; d) significant procedural component; e) the significant role of court practice. The periodization of the development of the legislation on agrarian receipts is proposed: 1) the preparatory (cameral) stage (2012-2014), which was characterized by the creation of basic regulatory and legal frameworks that did not actually operate; 2) the experimental stage (2014-2018), which was distinguished by internal phasing, the implementation of a pilot project, the establishment of organizational and institutional conditions for the functioning of agrarian receipts in the legal field; 3) the stage of development (from 2018 to today), the main features of which are the scaling of relations with agrarian receipts, the activation of rule-making initiatives, and the accumulation of court practice.
