Essay

The dissertation presents a theoretical generalization and a new solution to an important scientific task, which is the development of a comprehensive concept of the legal nature of public control and its digitalization. It is noted that digitalization significantly influences the scaling of society's control over the government, both in quantitative and qualitative terms. The greatest impact of digitalization on public control is manifested in the change of tools used by society to influence public authorities. The author’s viewpoint is defended that public control is aimed at identifying violations of legal norms by public administration bodies and their officials; at ensuring the conformity of state bodies’ functioning to legal and normative standards, and correcting detected deviations through appeals to authorized state bodies or public opinion. It is demonstrated that public control is directly related to the institution of digital human rights. One of the fundamental rights of individuals in the group of digital rights is the right to free access to the Internet, as this right interconnects with other rights and ensures their realization. It is established that the implementation of public control utilizes information systems (online platforms, digital platforms). These systems are divided into two main types: information systems (online platforms, digital platforms) that directly implement forms of public control; and information systems (online platforms, digital platforms) that serve a supportive role for public control. These systems (platforms) provide only access to information about the activities of public authorities, which is important for implementing certain forms of public control, but do not address other tasks related to the societal control over the government.
