Korniyenko G. Theoretical and legal bases of formation and development of agribusiness in Ukraine.

The dissertation is devoted to the decision of a scientific problem on development of the concept of the law of agribusiness as an integral part of science of agrarian law and agrarian-legal policy, and also formation of integral, doctrinal representation of the place of the agribusiness right in agrarian law system. The scientific work investigates the genesis of the formation and development of agribusiness in Ukraine, analyzes the current state of legal regulation of agribusiness, and clarifies the nature and place of the category «agribusiness»; in the system of agrarian law. Methodological approaches to the studying of the foundations of the formation and development of agribusiness in Ukraine have been established. The concept, structure and classification of legal relations in the field of agribusiness are revealed. The signs, of legal personality of participants in relations in the field of agribusiness, are given. Special attention is paid to the analysis of logistical legal relations in the field of agribusiness, which is a short story in the theory of agrarian. The content of such definitions as «agribusiness entities», «agribusiness entities/outsiders» is revealed. The legal status of agrarian multinational corporations is described. The scientific and theoretical analysis of the state support of agribusiness subjects, and the problem of social responsibility of these subjects in modern conditions is also carried out. The ways of protection of the rights of agribusiness entities have been identified and some proposals to further improvement of legislation in this sphere have been made. The definition of the constructions «raiding in the field of agribusiness», «offenses in the field of agribusiness» discloses jurisdictional and non-jurisdictional forms of protection of the rights of agribusiness entities. For the first time, the directions for improving legislation in the field of agribusiness are proposed, which is possible, in particular, through the gradual adoption of a separate special Law of Ukraine «On Agribusiness».
