Babich N. Legal regulation of judges' labor relations

The dissertation is devoted to a comprehensive and thorough study of the legal regulation of judges' labor relations. In this work the legal nature of judges' labor relations is clarified, the preconditions for the legal regulation of judges' labor activity are characterized, the international legal standards for the performance of judges' work are investigated. In the dissertation, for the first time, a comprehensive list of special features of a judge's employment relationship is provided. The author's concept of "differentiation of the legal regulation of the work of judges" is proposed, the peculiarities of the emergence of the labor relations of judges of the CCU are formulated, the definition of "labor disputes of judges" is substantiated. Also in the dissertation the characteristics of the stage of formation and development of the normative regulation of the work of judges in Ukraine were improved. The proposals for improvement of the national legislation, as well as for the definition of the concept of "individual labor rights of judges" are given, the stages of the procedure of bringing judges to disciplinary responsibility are highlighted.
