Essay

The presented Ph.D. dissertation is a comprehensive study of theoretical and practical issues directly related to the creation and operation of international maritime canals and the development and implementation of legal basis for activity of management companies. Based on the analysis of scientific literature and normative legal acts in the dissertation, the origin and evolution of legal regulation of the Suez and Panama canals exploitation, their legal regime and status through the prism of compliance with international standards and requirements for demand for services, ensuring the safety of navigation, the action of national sovereignty were examined. The international legal characterization of the status and regime of the studied channels is carried out. The thesis notes the evolution of the legal status of the Suez and Panama Canals, based on the modernization of approaches to the legal regulation of activities as a kind of extraterritorial maritime zone. In general, the dissertation is a comprehensive study, which for the first time reflects the holistic process of forming the legal framework of the regime and the status of the Suez and Panama Canals since colonialism and the liberation of countries from colonial dependence. The development of the idea of an international channel in the doctrine of international law, in particular the implementation of the idea of channel concession, is traced, and at the same time highlighted the genesis of views on the channel management system, from external management to full transition to national jurisdiction.
