Thesis submitted for the degree of Doctor of Philosophy in Law (81), speciality 081 “Law”. – Educational-scientific Institute of Law of Taras Shevchenko National University of Kyiv. Kyiv, 2021. The dissertation is devoted to a comprehensive theoretical and legal and comparative legal study of the role of the European Court of Human Rights as a leading guarantee in terms of national mechanisms of judicial protection of human rights and freedoms in Ukraine and EU member states. The dissertation research was based on the theoretical achievements of domestic and foreign scholars, as well as international legal documents of the UN, the Council of Europe, the European Union, as well as the case law of the European Court of Human Rights. In addition, the paper contains a thorough analysis of the constitutional practice of the member states of the European Union and Ukraine. This made it possible to extensively explore these issues, implement their comprehensive vision and suggest possible ways to improve. The dissertation contains the following components: introduction; four interconnected sections, which consistently and logically reveal the research topic and consist of a total of eleven sections; as well as conclusions.
