Essay

The dissertation is devoted to the complex research of universal jurisdiction in international law. It is revealed that the doctrine of international law has not yet developed a single, unified approach to the understanding of universal jurisdiction, so its functional definition is proposed. The author analyzes the formation and functioning of this concept, developed a classification of stages of its development. The following periods are distinguished: the formation of a general universal jurisdiction based on the cooperation of states, from 1648 to 1899; the application of universal jurisdiction based on cooperation from 1900 to 1945; and the limited application of universal jurisdiction unilaterally, which is characteristic of the current stage in the history of international law. The paper presents the types of universal jurisdiction, the application of which is tied to the chronology of its development. Accordingly, these types include the following: general universal jurisdiction based on the cooperation of states; limited universal jurisdiction based on cooperation and limited universal jurisdiction applied unilaterally.
