Essay

The dissertation research is focused on a comprehensive study of the administrative and legal status of the Expert Service of the Ministry of Internal Affairs of Ukraine and clarification of the content of its certain elements. The essence of the Expert Service of the Ministry of Internal Affairs of Ukraine as a subject of forensic activity has been revealed through the following definition: it is a set of leading state specialized institutions with experts – specialists in various fields of knowledge conducting expert, in particular forensic research in the field of criminalistics in order to ensure the interests of pre-trial investigation, trial, as well as the interests of others entities beyond the sphere of justice. The author has improved understanding of the content of legal regulation of the activities of the Expert Service of the Ministry of Internal Affairs of Ukraine, as a result of which the relevant regulatory legal acts are classified by: legal force; the subject of rule-making; level of regulation; branch affiliation; scope; direction of regulation. It has been argued that the place of administrative legislation in the system of legal principles of the Expert Service of the Ministry of Internal Affairs of Ukraine is due to its dualistic nature of legal regulation, which is stipulated by its implementation in two directions: 1) organizational and functional that is related to the provision of this Service activities; 2) administrative and procedural, which directly regulates the grounds, procedure, conditions and principles of implementing forensic examinations and expert research in administrative cases and cases on administrative offenses.
