Vorobey V. Forensic characteristics and іnvestigation of sexual violence against a person who is in a family or close relationship

The thesis is devoted to the complex research of the legal, theoretical, organizational and tactical principles of forensic investigation of sexual violence against a person who is in a family or close relationship, given the regulations of current criminal procedure law. Theoretical principles are studied and the recommendations for solving the problematic aspects of the pre-trial investigation of sexual violence against a person in a family or close relationship are scientifically substantiated. The study of the state of modern scientific and theoretical research has confirmed the existence of problems of proof during the pre-trial investigation of sexual violence against a person who is in a family or close relationship. The own definition of the concept of sexual violence against a person in a family or close relationship is formulated, which should be understood as physical, sexual or psychological influence (action) of a sexual nature, not related to penetration into another person's body, without his consent, on the person by using violence or threatening to use it on the part of parents, persons replacing them, as well as other persons who are in a close relationship. The classification of manifestations of sexual violence against a person in a family or close relationship is singled out and provided, it includes: rape, coercion or incitement to sexual intercourse, sexual intercourse with a person who has not reached sexual maturity, coercion of one of the spouses to satisfy sexual intercourse unnatural passions, forcing a person to undress against the will, taking photographs in sexual poses, forcing to watch and / or repeat pornographic acts, physical coercion or otherwise inciting prostitution, pornography or having sexual intercourse with other people.
