Klymovych N. Organization and activity of judicial bodies of regional associations of economic integration

The dissertation study is devoted to the analysis of the features of international legal regulation of the organization and activities of judicial bodies of regional associations of economic integration (RАEI). Attention is paid to the implementation of the norms related to the resolution of disputes under the 2014 Agreement on the Association of Ukraine with the EU. The author analyzes various models of integration adopted in the practice of RАEI, and singles out EU law, MERCOSUR law, the legal order of the Andean Community, EurAsEC law, etc., as separate legal orders united within the framework of integration law. In essence, the EU integration model differs from the integration models used in Latin America and Africa. The European model is based on the construction of supranational bodies and the system of judicial control and protection associated with them, while in other regions integration mechanisms are built on the basis of intergovernmental cooperation, which are characterized, as key, by the decisions of the bodies represented by the heads of states, and interstate negotiations without the involvement of union bodies are key to resolving significant disputed situations. Decisions of integration bodies in most cases, although they are mandatory, do not have direct effect and cannot be applied quickly. This is largely related to the peculiarities of the legal culture of these regions.
