Pyskun O. Administrative and legal status of the commander of the National guard of Ukraine

The dissertation is devoted to the study of the administrative and legal status of the commander of the National Guard of Ukraine. It has been established that the relevance of the issue of the administrative and legal status of the commander of the National Guard is due to the still ongoing discussion regarding the determination of the specifics of the implementation of certain areas of the legal status of the head of the National Guard, among which the following are of primary importance: a) the procedure for appointment to the post and dismissal from the post; b) description of the functional support and the specifics of the administrative tasks performed; c) procedure for making and implementing management decisions; d) determination of directions of interaction of the head of the National Guard with other military formations and law enforcement agencies, etc. The concept of the administrative-legal status of the commander of the National Guard of Ukraine is defined as a systematized set of administrative-legal norms that regulate his legal position as a military officer of the NGU, empowered to exercise direct military leadership over the bodies and units of the National Guard, and a specific administrative-legal nature, which consists in the implementation by the head of the NGU of the function of dual subordination, which provides for the performance of the duties assigned to him in peacetime as part of the Ministry of Internal Affairs and in a special period under direct subordination to the Commander-in-Chief of the Armed Forces of Ukraine.
