The dissertation is one of the first comprehensive monographic studies in Ukraine, in which, based on the analysis of theoretical and praxeological sources, the current state of criminal and criminal procedural legislation and the practice of law enforcement agencies, the received empirical data, a criminological characteristic is provided and a system of measures to prevent criminal offenses committed against foreigners in Ukraine. The work substantiates a number of new conceptual provisions, conclusions and recommendations.
Based on the generalization of operational, investigative and judicial practice, a conceptual vision of the system for preventing criminal offenses committed against foreigners is proposed in the context of the implementation of the state criminological policy as a tool for ensuring the national security of the state, highlighting information on the state and trends of such ethnic crime, determinants, criminological characteristics of a person - the criminal, organized groups, victimological characteristics of the victim-foreigner, which influence the choice of effective praxeological measures of prevention at the general social, special-criminological, individual-preventive and victimological levels in the conditions of current criminal, criminal procedural and operative-search legislation.
Systematization of scientific research on the problems of preventing criminal offenses committed against foreigners allowed us to talk about foreigners as a specific object of criminological research, which in a broad sense includes persons who do not possess the citizenship of a given state (foreigner, stateless person, refugee) and in the narrow - persons who do not hold the citizenship of this state and have evidence of their belonging to the citizenship of another state; victim behavior of foreigners as an external form of manifestation of victimhood of a foreigner (special-role (business-victimhood), competitive-labor, educational-conformist, tourist victimization, victimological deformation of the person associated with military actions), which is formed under the influence of a number of objective and subjective factors (verbal and non-verbal) that, in a certain situation of interaction with a criminal, contribute to the transformation of a foreigner into a victim of a criminal offense (credulity, indifference to security measures and, as a result, a natural choice of them as objects of offense), as well as a model of criminal behavior in format of relations «foreigner-criminal-conflict situation-victim».
