Zavada R. Adaptation of European e-government standards: an administrative and legal study in Ukraine

The dissertation represents a comprehensive examination of the legal regulation of e-governance in Ukraine in the context of its adaptation to European standards of functioning. A comprehensive analysis of e-governance as an administrative law institution is conducted, delving into the conceptual underpinnings of its operation within the domain of public administration. This study encompasses the establishment of fundamental standards and principles of e-governance, while also scrutinizing the various domains where adaptation to European administrative and legal norms is sought in Ukraine. The applicant has developed a model of comprehensive improvement of the functioning of the system of public electronic registers, including: regulatory (amendments to the Law of Ukraine "On Public Electronic Registers", development of the State Target Program for the Development of Integration and Interoperability of the System of Public Electronic Registers); management (creation of a single management center for the management of public electronic registers); technical and organizational (formation and implementation of the Register of Public Electronic Registers and updating the Trembita technical system of electronic interaction by harmonizing it with EU requirements and standards, ensuring continuous monitoring of problems and cyber threats) guarantees. The author proposes a set of measures for the development of national legal policy with a view to adapting progressive standards of e-government in Ukraine, including: adoption of a single comprehensive regulatory act in the field of e-government; harmonization of the criteria for compatibility and interaction of the national e-government system and its elements with partner countries; transition to a proactive form of administrative services provision without a request from a person; prioritizing user-centered design, including for users with low digital skills and disabilities; implementing a set of administrative measures to increase the level of knowledge of various target groups about the possibilities of using the e-government system. The author suggests the regulation of administrative liability in the domain of ensuring the appropriate functioning of public registers through the inclusion of Article 145 1 , titled "Violation of the terms and conditions governing activities in the area of public registers and other national electronic information resources," into the Code of Administrative Offenses. A draft version of this proposed article is also presented.
