Essay

Esports is a team or individual competition based on video games. Cybersport, as a unique type of human activity, arose as a result of the combination of achievements in the field of information technologies and traditional sports. Modern technologies have made it possible to reproduce the competitive process, which has been taking place on the competition grounds for thousands of years, in a virtual dimension. However, by its very nature, eSports does not differ from "traditional" sports, because it also objectifies competitive activity, which is the essence of sports as such. Accordingly, social relations that develop in the field of e-sports also need their own legal and quasi-legal regulation, according to the same principles that are used in "traditional" sports. It is primarily about self-regulation at the level of e-sports organizations and contractual regulation at the individual level. Therefore, there is an objective need for a scientific understanding of e-sports as a separate area of legal regulation, and the formation of established approaches to the regulation of heterogeneous social relations that are formed in the researched field. The issues of contractual regulation of relations in the field of e-sports require special attention since the majority of them are not regulated through regulatory and legal acts. The dissertation is the first special comprehensive study of civil law contracts in the field of e-sports in domestic science. In the work, the main attention is focused on the issues of legal regulation of various relations that are formed in the field of e-sports in general and the peculiarities of the application of civil-law contractual constructions for the regulation of private law relations in particular. The dissertation developed new theoretical provisions for solving issues of contractual regulation of relations in the field of e-sports, in particular, - analyzed in detail the legal constructions of an agreement (contract) on e-sports activity, transfer agreement (contract) of an e-athlete, sponsorship agreement in e-sports, and made suggestions for improving the current legislation of Ukraine. As a result of the conducted research, it became possible to formulate separate provisions of scientific novelty and practical recommendations regarding: 1) theoretical and methodological principles of contractual regulation of private law relations in the field of e-sports; 2) existing approaches to regulatory and legal support for the implementation of e-sports activities based on the analysis of the legislation of Ukraine and foreign countries; 3) determination of the role of the state and private entities in the formation of the mechanism of normative and legal regulation of relations in the field of e-sports, taking into account the principle of the autonomy of sports. It has been established that eSports is a gaming activity in which opponents compete for supremacy in a computer game. The key aspect that determines the essence of eSports and directly affects the determination of the methods and directions of its legal and non-legal regulation is the recognition of the dualistic nature of eSports, which arose at the junction of information technologies and traditional sports. It is emphasized that the emergence and development of e-sports are directly related to the development of pure computer and later Internet technologies. The stages of the development of eSports include the early period (1972-1980), the period of popularity of arcades (1980-1990), the period of the emergence and spread of online games (1990-2000), the modern period associated with the emergence of large eSports tournaments (2000- present days). It is argued that the need for legal regulation of relations in e-sports is due to the development of e-sports as a sport and a powerful industry. Accordingly, the genesis of the legal regulation of e-sports does not coincide with the periodization of the development of e-sports, since the need for legal regulation arises already at the stage of the formation of e-sports as a separate industry. Thus, the periodization of the development of legal regulation of e-sports consists of two stages: 1) regulation of certain spheres of public relations in e-sports, for example, related to the conclusion of certain types of contracts, registration of rights to broadcast competitions, etc. – 2000-2011; 2) transition to comprehensive regulation of relations in e-sports as an independent sport – from 2011 to the present time (in Ukraine – from 2020, when e-sports was officially recognized as a sport).
