The dissertation is one of the first comprehensive studies in Ukraine of the theoretical and practical principles of obtaining samples for examination in criminal proceedings as an effective means of forensic tactics in the context of modern criminal procedural legislation of Ukraine and the compliance of the activities of law enforcement agencies with international standards of justice. The work substantiates a number of new provisions, formulates conclusions and recommendations.
During the research, the most significant complications associated with obtaining samples for examination in criminal proceedings, which arise in the practice of law enforcement agencies, were identified, and they were taken into account when determining the tasks of the dissertation research. The state of scientific research on the problems of obtaining samples for examination in criminal proceedings is highlighted and it is established that, unfortunately, these issues have not been systematically investigated in Ukraine at the monographic level. Attention is drawn to the fact that from the criminal-procedural aspects, the specified problem was investigated at the monographic level by O. V. Kozak, V. I. Galagan, and S. O. Koropetska. The following Ukrainian scientists devoted their works to certain aspects of obtaining certain types of samples for examination in criminal proceedings: P. E. Antonyuk, A. O. Antoshchuk, O. V. Baulin, N. S. Karpov, L. T. Kotlyarenko, V. Rohalska and others. It has been proven that the specified developments in the complex do not reveal the subject of the study.
In the course of the study, the author's definition of obtaining samples for examination was proposed, which is understood as an investigative (research) action aimed at collecting evidence-samples from a specific object (substance) and acting as a means of forensic tactics, through which not only the development of forensic theory is implemented, but also the personal professional competence of the subject of the investigation. It has been proven that obtaining samples for examination, as a means of forensic tactics, consists of four interrelated stages that ensure the collection of reliable and credible evidence: 1) preparatory; 2) direct implementation (working); 3) fixation of results; 4) evaluation of the obtained results.
