Vynohradova A. Administrative and legal principles of staffing the courts in Ukraine

The dissertation is devoted to the formation of the theoretical basis and determination of the administrative and legal framework for staffing of courts in Ukraine, and to identifying ways to improve the administrative and legal regulation of staffing of courts, taking into account: the provisions of the national administrative law doctrine on the content of public service in courts, the content and features of the relevant administrative law institutions, administrative procedures for staffing of courts; the practice of applying the relevant administrative law instruments. Within the framework of this work, the author characterizes the public service in courts, reveals its nature (professional nature) and scope (applies to all positions of public service in courts), tasks and focus, and type of affiliation (it is a component of the public service in the judiciary). The author identifies the features of public service in courts. The organizational, support and law enforcement tasks of the public service in courts are revealed. The author systematizes the public service in courts. The author reveals the impact of the peculiarities of public service in courts on the staffing of courts' activities, which is carried out through: the list of entities authorized to carry out staffing; forms of making managerial decisions on staffing; staffing procedures. The author systematized the procedures for staffing the courts. The principles of court staffing were systematized according to the criterion of the type of public service in courts: judicial, administrative and militarized (the Court Bailiffs Service and the Court Security Service). The author characterizes the principles for each type of public service in courts with due regard for its specifics. The general and specific features of the subject of court staffing are highlighted. The author systematizes the subjects of court staffing. The author substantiates the need for legislative consolidation of a more active role of the court in staffing the position of the chief of staff of the court. The author systematizes the administrative procedures for staffing the courts by the following criteria: the positions to be staffed by administrative procedures in the court staffing table; components of the civil service in the court. The author systematizes the areas of international experience in court staffing which are promising for implementation. The author systematizes the areas of development of administrative and legal regulation of court staffing by the criterion of their scope of influence: optimization of general provisions on court staffing; optimization of court staffing in a narrow or broad sense
