Kholmohorova L. Theoretical and practical problems of opening a lawsuit in a civil process

In the dissertation work, for the first time since the thorough renewal of civil justice in 2017, a systematic and comprehensive theoretical and applied study of the stage of opening a lawsuit in the civil process of Ukraine was conducted. The opening of a lawsuit in a civil process is a mandatory stage that begins the lawsuit and is characterized by the presence of a specific goal and tasks. The purpose of the stage of opening a lawsuit is the preliminary formation of a civil case for its further consideration by the court of first instance. The tasks of this stage are acceptance of the claim and verification of its admissibility. The specified goal shows the final result of the procedural behavior of the court and the plaintiff (the person who filed a lawsuit) at the stage of opening the lawsuit, while the tasks clearly determine the direction of their behavior. The purpose and tasks of the stage of opening a lawsuit determine its content. The content of the stage of opening a lawsuit is the procedural actions of the court and the plaintiff (the person who filed a lawsuit with the court). Their procedural activity ensures the movement of a civil case from start to finish within this stage.
