Krykunov O. Civil Action for Compensation of Moral Damage in Criminal Procedure of Ukraine.

The theoretical aspect of research is devoted to the analysis of claim for non-pecuniary damage compensation as well as its place within the system of criminal procedure and means of right renewal. In order to solve different problems within the sphere the author defined actors of legal relations in respect of moral damage compensation as well as the scope of circumstances that should be proven. The author also stated and developed ideas that moral damage is presumed in all occasions and compulsory expertise should be exercised in order to define mental condition of a victim. The author elaborated methods of evaluation of victim's suffering as well as adequate pecuniary compensation of it.
