The dissertation studies the situation and problematical questions of investigator's activity as the subject of proof. The factors having an influence on investigative activity and negatively affecting the proof procedure in pretrial stages are analysed. The proposals for the acting legislation and the draft of CPC of Ukraine have been formulated with the purpose of authorization of investigator's status and improvement of his importance in fighting crime.
