Kuzminova V. Legal and scientific fundamentals of recovery (renovation) on lost criminal cases.

Thesis is the research, in which at a monographic level are worked up actual legal, theoretical and practical problems of recovery (renovation) on lost criminal cases. It is made the analysis of problems, which are connected with definition of concept, content, structure and kind of criminal cases, is uncovered its remedial nature, typical indications and its value. It is detected the recovery nature of lost criminal cases and it is investigated its subject. It is determined the occasions, basis and renovation terms of called cases. It is worked up the scientific fundamentals on remedial technologies of recovery on lost criminal cases, are formulated the recommendations ensuring the efficiency on given kind of reconstructive activity on charge of preliminary investigation, consequent and court. It is introduced scientifically- justified proposals, which are directed on advancing of the current legislation and departmental statutory acts on studied problems and also the mining of a new code of CriminalProcedure of Ukraine.
