Essay

The present paper investigates the theoretical and practical problems of realization of guaranties of rights and freedoms of a person and a citizen in Ukraine, their evolution, conception and place in system of the constitutional law of Ukraine. The basic criteria of classification of guaranties of rights and freedoms of a person and a citizen are investigated and analyzed in it. The work presents the reasonable characteristic of the system of guaranties. The special place occupies the analysis of the normative-legal guaranties (norm-principle, the legal responsibility, duties), which guarantee the rights and freedoms of a person and a citizen in Ukraine. The classification and the substantial characteristic of the organizational-legal guaranties are conducted in the dissertation. The practical offers about improvement of the current legislation in the field of the guaranties of the human right have been given in this research. In the dissertation an author analyses the international normative-legal and organizational-legal guaranties of rights and freedoms of a person and a citizen in Ukraine, bases the necessity of the ordering of the legislation in the field of the human right and the acceptance of the complex scientific Conception of the development of the Ukrainian legislation. The purpose of this Conception is the conformity of the Ukrainian legislation to the international standards.
