Bugajchuk K. Administrative misdemeanors: essence and organization-law measures of their prophylactics

Dissertation is devoted to the analysis of essence of administrative misdemeanor and organization-law measures of their prophylactics. The thesis investigates the essence of administrative misdemeanor as social and law phenomenon, its place among other misdemeanors, it also defines corpus administrative delicti, its structure and significance. The dissertation analyses the reasons of committing administrative misdemeanors and conditions that promote to them. It also investigates the personality, which committed administrative misdemeanor and its illegal behavior. It gives the detailed investigation of the prophylactics of administrative misdemeanors, its content and varieties. It defines the main measures of prophylactics of administrative misdemeanors. The author formulates suggestions in improvement of existing legislation in relation to the activity on prophylactics of administrative misdemeanors. In particular the author of dissertation presents for consideration the "Concept of the activity of organs of internal affairs on prophylactics of administrative misdemeanors", Concept of the law draft "About foundations of the state system in prophylactics of administrative misdemeanors" and directly the draft of the law of Ukraine "About foundations of the state system in prophylactics of administrative misdemeanors" for the further legislative consolidation.
