The dissertation contains a set of matters relating to the determination and justification of the principal ways of harmonization of the national trademark legislation with the international law provisions. The author researches the trademark's juridical nature; discusses the content of the basic terms of the trademarks protection; proposes the solutions to the problematic questions related to the acquisition, exercise, and protection of the trademark rights in Ukraine. The author offers the definitions of the union trademark, certification trademark, world-renowned trademark, and famous trademark; proves the necessity of the adding of the concept of a trademark applicant acting in bad faith to the Ukrainian legislation; covers the domain and scope of the trademark owner's prohibitive powers; determines the principal ways of the protection of the trademark owner's rights in the Internet. According to the results obtained during the research process the author formulates the specific propositions concerning the improving of the trademarks legal protection system in Ukraine and bringing it in compliance with the international standards and requirements.
