The dissertation is devoted to the research of problems dealing with theory and application of law; refering the origin of employment legal relations with the participation of state employees. Scientific statements concerning mutual actions of conditions and grounds for the origin of labour relations within the state employment have been proved and confirmed; the legal essence and significance of competitive approach towards the problem of admission for state employment are being defined; the problems of probation terms and personnel reserve are being formulated .
