Essay

The dissertation is devoted to a thorough, comprehensive and integrated analysis of the doctrine of social security of civil servants in Ukraine. The article provides a general theoretical characterisation of social security of civil servants. The concept, essence and features of social security of civil servants are defined. The author establishes that social security of civil servants is a specific state of security under which each civil servant has the opportunity to exercise his/her rights and duties, effectively perform his/her official duties, and realise his/her professional, creative and personal potential, which is achieved through the introduction by the State of a number of economic, social, organisational, domestic and legal guarantees. The author characterises the advantages and disadvantages of legal regulation of social security of civil servants. It is proved that the advantages of legal regulation of social security of civil servants are: 1) strengthening of social security of civil servants with the growth of experience and improvement of skills; 2) detailed regulation of social security of civil servants in the provisions of legislation; 3) provision of civil servants with effective forms of social security; 4) combined legal regulation by the provisions of general and special legislation. The shortcomings of legal regulation of social security of civil servants include: 1) civil servants do not have the opportunity to receive financial support from other sources. 2) the scope of the components of social security of civil servants is gradually decreasing. The legal basis of social security of civil servants is studied. The social rights of civil servants are analysed. The main types of social rights of civil servants include: the right to engage in labour activity (the right to work); the right to material and social security of civil servants; the right of civil servants to rest; the right of civil servants to health care; the right to pension provision. International social standards for civil servants are studied. The author proposes to classify international standards on the issues of provision of civil servants' social security into general and special standards. General standards are determined by universal international and regional documents and acts. Special standards for civil servants contain a number of norms and principles governing applied issues of social security of service activities and exercise of the right to work by government officials. The levels and areas of social security of civil servants are defined. The individual social security of a civil servant is provided at the following levels: at the level of a public authority; at the level of the State. The areas of social security under modern legal regulation include: remuneration of civil servants; motivational component; social and amenity provision of civil servants; creation of appropriate working conditions; and determination of the specifics of work and leisure.
