Golovan I. Legal Work in the Mechanism of Protection of Rights of Subjects of Business Undertakings

Object of research: set of the economic relations arising during protection of the rights of the subjects of business undertakings. The purpose of research consists in definition of essence of legal work and its role in realization of protection of the rights of the subjects of business undertakings in economic and legal relation; in a substantiation of necessity of application of effective system of methods of protection of the rights and lawful interests of the businessmen. A method of research: general scientific and special methods of scientific knowledge of the validity: historical, dialectic, analysis and synthesis, logic, legal, system-structural, comparative-legal. Theoretical meaning: the necessity of wider use of opportunities of legal work for economy which provides activization of actions of subjects of business undertakings on increase of a level of realization of the current legislation directed on protection of their rights and lawful interests is proved; the features of application of methods of protection of the rights and interests of the subjects of business in sphere of the greatest distribution of infringement of these rights - at realization by state supervising bodies of checks of finance-economic activity are opened. The practical meaning consists that the separate conclusions and rules can be used in the subsequent scientific elaborations devoted to questions of organization of legal work and realization of protection of the rights and lawful interests of the subjects of business undertakings and also in educational process, in particular, in special course "Organization of legal work in economy". The conclusions and rules of the carried out research, system of means and methods of protection of the rights of the subjects of business undertakings successfully are used in practical activity of advocatory association "Pravis" (Donetsk) of the separate subjects of managing during legal work. Scientific novelty: the role of legal work in feasible protection of the rights and lawful interests of the subjects of business undertakings in new economic conditions for the first time complex is investigated; the new offers concerning improvement of the legislation which adjusts the relation of the subjects of business and state bodies by introduction of remedial norms are formulated. Sphere of use are law-making bodies of the central authority; the subjects of managing; higher educational institutions.
