Essay

The dissertation is devoted to a comprehensive study of the problems of conflict of interests in the field of management. On the basis of the analysis of the sequence of general principles of business in Ukraine, the most effective approaches to the settlement of the conflict of interests in the establishment of norms according to the sectoral principle and the existence of a definition of the conflict of interests as a general concept, which may be unrelated to the manifestation of corruption in the economic and/or civil code of Ukraine, are argued. The effectiveness of special measures in the management structure of business entities that correspond to the competent duties and capabilities of a separate unit is substantiated. On the basis of the conducted research, special measures are proposed in the management system of the business entity: corporate codes of conduct and ethics, approved decision-making standards (rules), internal control and audit measures prove the effectiveness of their provision due to their close relationship with the management system and the structure of the sub of the enterprise. It has been proven that special measures for the settlement of the conflict of interests in the management system of the economic entity reflect a clear sequence based on the principle «from general to special». The same principle underlies their perception as compliance measures that can be considered as the basis for the emergence of binding legal relations.
