Khoroschak N. Administrative penalties and their application.

The dissertation is dedicated to research of lawful nature of administrative penalties. The author has determines a place of administrative penalties in the system of measures of administrative compulsion and in the institution of administrative responsibility. The author elucidates such terms as "administrative compulsion", "administrative responsibility", "administrative sanction of the law", "administrative penalties". The main characteristics of administrative penalties, which allow the difference them from other administrative sanction of the law, are described in the work. According to the complex of typical features noted in the dissertation, administration sanction of the law can be qualified among lawful and economic sanction. Thus, we can say about their belonging to the group of administrative penalties. At the same time the author of dissertation represents an additional argumentation of some problems. In particular, it concerns the formation of separate sort groups of administrative penalties, the criteria of their classification and grouping according to the special characteristics. The author also explores problem of division of administrative penalties into the main and additional penalties.
