Stojka V. Protection of the Investment Subjects' Rights

Object of research: system of protection of the rights and interests of the subjects of economic activity. The purpose of research: a substantiation of the general approach and directions of perfection of the legislation about protection of the investment activity subjects' rights and practice of its realization. A method of research: system and structural, formal-logic, comparative-legal, analysis and synthesis, statistical, historical. The theoretical meaning consists in the current legislation of Ukraine and foreign countries, and also scientific literature on protection of the investment activity subjects' rights is analysed; the offers concerning improvement of the current legislation of Ukraine which can be used during elaboration of theoretical problems of development of the economic legislation of Ukraine, coordination of the investment legislation with other branches of the economic legislation are given . Practical meaning: the mechanism of practical realization of the legislatively fixed ways of protection of the investment activity subjects' rights which establishes the order and features of practical application of ways of protection of the rights of the subjects of investment activity is determined . The conclusions and offers of dissertation are used in lawmaking process and in local rule-making Donetsk Regional State Administration, and also have found an application in educational process at lecturing and realization of practical training in Donetsk State Academy of Management МES of Ukraine at study course: "the Economic ", "the Investment Law". The scientific novelty: the features of protection of the investment activity subjects' rights are investigated; five basic ways of protection of the investment activity subjects' rights are allocated and considered. One more the way of protection - guarantee - is offered. The features of protection of the investment activity subjects' rights in conditions of a special mode of investment activity are revealed. Sphere of use are lawmaking bodiesof the central authority; higher educational institutions.
