Knizhenko O. Remission of penalty with probation according to the criminal law of Ukraine

The thesis systematic scientific research on the problem of the remission of penalty with probation was carried out. The essence of this kind of penal effect on the convicts and reasons of its application were determined. The necessity, possibility and expediency of creation of an independent institute of the Generality of the criminal law "Probation" which is understood as a probation system which the court applies to the persons who can reform without serving a sentenced main punishment was justified. Propositions concerning improvement of the existing Criminal Code were formulated and substantiated.
