Orlean A. Social conditionality of criminalization and crime-law characteristic of trafficking in people

The dissertation is devoted to the complex of questions of theoretical and practical character connected with social condition-ality of criminalization of trafficking in people and judicial analysis of the corpus delicti of the article 149 of the Criminal Code of Ukraine. The author has researched the history of forming of legal concept "trafficking in people". The world experience of criminali-zation of traffic in people was analyzed. The author has suggested the new approach to the term "trafficking in people" that could be used in national and international law. The modern situation of traf-fic in people in Ukraine, reasons and conditions of such phenome-non were showed. Great attention was paid to the theoretical grounds and principles of criminalization of trafficking in people. The author analized objective and subjective elements of the corpus delicti of trafficking in people. On the basis of the results, received during research, the author of dissertation develops the offers con-cerning improvement of Ukraine criminal legislation which pro-vides the responsibility for trafficking in people.
