Anisimov G. Abuse of Trast as a Way of Crime Committion

This dissertation is devoted to the abuse of trust as a way of crime commission. The author looks at the notion of the abuse of trust as a way of crime commission (as a gender (type) notion), its objective and subjective characteristics, types of trust relations depending on their origin, types of the abuse of trust, its delimitation from defraud and psychological violence as well as its ratio and interaction with other aspects of the corpus delicti. The author is working on the issues of classifying crimes committed by the way of trust abuse, overcoming provisions rivalability and establishing the aggregate of crimes. He shows its importance for differentiation of criminal liability and individualization of punishment. He formulates recommendations as to the improvement of the relevant provisions of the present Criminal Code of Ukraine.
