Plujnik E. The criminal liability for disturbance of enduring the punishment and custody.

The dissertation is dedicated to a problem of the criminal liability for disturbance of enduring the punishment and custody (item art. 390 - 393 CL of Ukraine). The factors of the social conditionally of such responsibility are investigated; objective and subjective tags of crimes encroaching on a mode of enduring the punishment and custody; qualifying tags of propagate from the place of confinement or custody; the punishment, and also is conducted demarcation above of crimes from the adjacent invasions. The necessity of installation of the responsibility for acts, foreseen in investigated group of crimes is argued, in one article CL of Ukraine and its edition is offered. The necessity of depositing of a series of changes to the order № 2 Plenums of the Supreme Court of Ukraine from March 26, 1993. "About judiciary practice on business about crimes, bound with disturbance of enduring the punishment in the places of confinement" concerning proficiency of investigated crimes is demonstrated.
