Shеmyakov O. Legal regulation of subsoil assets use and protection

The dissertation is devoted to the complex and thorough research of legal problems of regulating social relations in the field of subsoil assets using and protecting which is conducted in Ukraine for the first time. The author dealt with the peculiarities of legal regime of such state resources as the subsoil assets, the necessity of legislative consolidation of items of general and secondary subsoil assets using Law. It is pro-posed to separate legislatively the license permission as an administra-tive act and the license agreement as a treaty. The complex approach to legal regulation of the subsoil assets use and protection is realised in the author's proposals which are embodied in the corresponding articles of the new draft of "KUpN". The above mentioned draft consolidates new legal institutions of using subsoil assets, which are absent in the present legislation, and at the same time gives concrete expression to their realisation in the sepаrate norms.
