Essay

The issue of administrative and legal status of the State Motor Licensing and Inspection Department has been studied. Historical and legal aspects of the formation and development of agencies of the State Motor Licensing and Inspection Department have been analyzed. Elements of the administrative and legal status of the State Motor Licensing and Inspection Department have been determined. Legal regulation of administrative activities of the State Motor Licensing and Inspection Department has been studied. Duties and rights, particularities of law enforcement, legal liability of employees of the Department and cooperation with other state agencies and public regarding road safety have been investigated. On the basis of historico-legal analysis and investigation of the particularities of legal regulation of the activities of the Department it has been concluded that the agency should acquire a status of controller. Principles of organization of the Department have been formulated. Jurisdiction, law enforcement and legal liability have been defined as elements of the administrative and legal status of the Department. The concept of legal regulation has been formulated and legal regime of the Department's activities has been described. Rights and duties of the Department have been classified. The author has proved that it is necessary to divide the rights and duties into two groups - general and special ones. Spheres of activities of the Department have been formulated and cooperation with other state agencies and public regarding road safety has been analyzed. The author has proved the necessity to classify grounds of militiamen's disciplinary liability as general and special ones. On the basis of the analysis proposals regarding perfection of the current legislation have been worked out.
